NAR Settlement

Recent legal developments have significantly impacted how sellers engage with real estate agents, particularly regarding commission structures. Historically, sellers would meet with agents, choose one to list their home, and negotiate commission rates that included a portion for the buyer's agent. However, allegations against the National Association of Realtors® (NAR) claimed that this practice violated antitrust laws by standardizing commissions, leading to reduced transparency and potential financial disadvantages for sellers. On October 31, 2023, a jury in the Burnett v. NAR case, ruled against NAR resulting in a $1.8 billion award for the plaintiffs prompting substantial changes in how commissions are handled.


Effective August 17, 2024, as part of a $418M settlement, sellers now have greater flexibility in how they handle commissions. Cooperative compensation is forbidden on the MLS (buyer concessions are ok), meaning sellers are not obligated to offer a set commission to the buyer's agent. Instead, they can negotiate these terms directly, whether through concessions or written agreements made in advance, giving them more control over their financial outcomes. Listing agents can still advertise these commissions through social media, flyers, and any website not connected to the MLS. Sellers are now more empowered to decide how much, if any, commission they want to offer to the buyer's agent, making it possible to maximize their proceeds from the sale; however, they should note that it may be in their best interest to offer said compensation to attract more buyers (similar to an accurate list price). This means navigating a more transparent and customizable transaction process, with the ability to tailor commission structures to better suit their financial goals.


These changes also emphasize the importance of understanding the new requirements for buyer representation, as buyers are now required to sign a buyer’s agreement where they agree to pay a commission to their agent.
